Arthur Renaud is a partner in Gowlings' Ottawa office and is a member of the Firm's intellectual property litigation department. He has expertise in patent, PM (NOC), trade-mark, copyright and trade secret litigation. He acts for leading domestic and international pharmaceutical, biotechnology and manufacturing clients.
In 2008, after 22 years of practice at the IP bar, Arthur was certified by the Law Society of Upper Canada as a specialist in all areas of intellectual property law.
Prior to joining Gowlings in 2010, Arthur was the leader of the national intellectual property litigation group of another prominent law firm. Arthur has appeared as trial and appeal counsel in numerous cases before the Federal Court of Canada, Federal Court of Appeal and the Ontario Superior Court. He appeared before the Supreme Court of Canada in 2004 in the landmark patent case (Monsanto v. Schmeiser) which confirmed that gene modifications are patentable subject matter.
In 2010, Arthur won the "Patent Case of the Year" award given by Managing Intellectual Property for his representation of a pharmaceutical company in a Patented Medicines (Notice of Compliance) Regulations proceeding.
Other representative cases include:
• Monsanto Company v. Rivett, 2009 FC 317, which clarified the proper approach to calculating an accounting of profits award in a patent case
• Sobeys Inc. ats Tradition Fine Foods Limited, 2004 FC 1011; affirmed 2005 FCA 342, in which Arthur's client successfully defended a trade-mark infringement claim
• The Canadian Copyright Licensing Agency v. U-Compute et al., 2005 FC 1644; 2008 FC 392, in which Arthur's client recovered a $700,000 damages award against a recidivist copyright infringer who was later imprisoned for contempt of court
• Kraft Canada Inc. v. Euro-Excellence Inc., 2004 FC 652, in which Arthur's client succeeded in preventing the parallel importation into Canada of products bearing copyrighted works Arthur teaches an advanced trade-mark course to students registered in Osgoode Hall Law School's part-time LLM (IP) program. He is a contributing author to LexisNexis Canada's publications Federal Courts of Canada Service, Canadian Federal Courts Practice and The Supreme Court Law Review; and Federated Press' Intellectual Property Journal.
Arthur is frequently invited to speak on IP issues and has delivered papers at conferences organized by the Canadian Bar Association, the Intellectual Property Institute of Canada and the Law Society of Upper Canada.
