Bettina Burgess is a senior associate in Gowlings’ Waterloo office. Her practice focuses on employment and labour law as well as commercial litigation.
Bettina advises Canadian businesses, from start up to established, on a wide range of employment-related issues. Bettina assists businesses draft employment or independent consultant contracts, confidentiality and work product agreements, policies, and handbooks. She also advises on methods of reducing employer liability and risk, employment standards statutory compliance, human rights compliance (including accommodation and investigating allegations of discrimination) and how to handle and structure a termination. She has defended wrongful dismissal actions and human rights applications from commencement to resolution through negotiated settlement or hearing. Bettina has given presentations on topics including: terminating for just cause, independent contractor or employee status, liability of employees for their own negligence, employee overtime claims, employee entitlements during leaves of absence, employment standards prosecutions and penalties, employee surveillance, pre-employment screening, employer reporting obligations and social networking and the workplace.
In addition, Bettina has published a number of articles on topics including: overtime requirements, options during an economic downturn, employee obligations upon resignation, employee fiduciary duties, Bill 118 (use of hand-held devices while driving), costs in the Human Rights system and various case commentaries.
