David Kierans is a partner in Gowlings' Montréal office, the head of the Firm's Business Law Group and sits on the office’s Management Committee. David practises in corporate and commercial law with particular emphasis on secured lending, real estate acquisition and finance and asset-backed financing.
He has, among other activities, acted for financial institutions with respect to mortgage loan investments, equity investments in real estate and other assets, disposition of assets, structured financing transactions involving aircraft, public and para-public infrastructure programs, consumer-oriented financing products (credit cards, leasing and condition sale contracts), cross-border transactions involving financing of equipment and syndication of financial product portfolios. Amongst past projects, David has participated in the financing of the Highway 30 public-private partnership road concession in Québec (named as North American PPP Deal of the Year for 2008 by Euromoney's Project Finance magazine) and has worked on the successful investment in Ontario’s Highway 407. Over the course of the past few years David has delivered seminars involving trust in the Province of Québec, rights of secured creditors under the Civil Code of Québec and with respect to contracts of leasing (crédit-bail) in the Province of Québec. He has also assisted in the preparation of Guidelines for Registering Security used by various financial institutions and in house counsel of such institutions.
