David Marchione is an Occupational Health and Safety (OHS) consultant and paralegal in Gowlings’ Employment & Labour National Practice Group, and a member of the national OHS practice.
David is a workers’ compensation claims specialist with national experience in advising clients across Canada on workers’ compensation claims management. As a former adjudicator with Ontario’s Workplace Safety and Insurance Board (WSIB), David has extensive workers’ compensation knowledge and expertise. He provides training and consulting services to clients regarding accident investigation, claims reporting, return to work and appeals. As well, David has assisted clients in developing and implementing comprehensive return to work programs, thereby decreasing compensation costs. In addition, David has represented clients during revenue audits, current and retroactive registrations, cost transfer applications, and at all levels of appeal, including the Workplace Safety and Insurance Appeals Tribunal.
David has facilitated training sessions for both large and small clients across Canada. Training has included legal rights and responsibilities for workers, managers and supervisors under both the Canada Labour Code Part II and provincial OHS legislation. As well, David has delivered training in topics such as workplace accident investigation, Joint Health and Safety Committee functions and powers, workers’ compensation claims management and trends in enforcement of OHS and workers’ compensation laws.
David provides litigation support for clients facing Orders and regulatory charges under both OHS and workers’ compensation legislation. He facilitates witness interviews and the collection, examination and preservation of evidence to support clients in gathering due diligence evidence defence, as well as assessments of clients’ OHS management systems for legislative compliance.
David has participated in speaking engagements with various professional associations and Chambers of Commerce.
David is a regular contributor to the Canadian Occupational Safety Magazine.
