Derrick Pagenkopf is an associate in Gowlings’ Calgary office, practising in the area of general civil litigation with an emphasis on insurance and corporate-commercial litigation including landlord and tenant matters. He has a particular interest in insurance coverage disputes.
Derrick has experience in construction litigation matters, including defence of architects, engineers, surveyors and other trades and professions, and has acted in large loss multi-party insurance coverage disputes. He provides advice with respect to indemnification and insurance of directors and officers and acts on behalf of shareholders with respect to misrepresentation and inter-shareholder disputes as well as disputes between shareholders and directors. He has appeared before all level of Court in Alberta and the Court of Queens Bench and Court of Appeal of Saskatchewan.
Derrick is committed to finding practical resolutions to legal disputes and has experience in management and creative resolution of claims involving difficult and unrepresented parties. He is experienced in various forms of mediation and dispute resolution including multi-party claims and Judicial Dispute Resolution.
Prior to practising law, Derrick spent 13 years in private and public healthcare, in both direct-care and administrative positions. Derrick has acted in coverage matters in large-loss energy related claims ($15 - $100 million) and in multi-party insurance disputes for both primary and excess carriers. His experience includes coverage disputes involving commercial general liability insurance, boiler and machinery insurance, property insurance, automobile insurance, course-of-construction insurance, and project liability and professional liability policies. Derrick has also acted in large loss fire claims.
Derrick represents a professional regulating body in disciplinary matters under the Health Professions Act and has acted as defense counsel with respect to professional discipline.
Derrick acts for landlords and tenants and has experience before the Courts in lease enforcement matters. Derrick has presented papers and seminars on duties of directors and officers, corporate disclosure obligations and insurance coverage matters. He has provided presentations on reducing risk of construction claims. Derrick has lectured on the pre-trial discovery process at the Alberta Bar Admission course.
Derrick has spoken at educational meetings of the Judges of the Provincial Court of Alberta and participated as a visiting lecturer at the University of Calgary intensive trial advocacy program.
