Mr. Clarke practises in the area of Business Law with a particular interest in greenhouse gas emissions regulations and carbon finance. He joined Gowlings in September of 2005 after articling and practising with another firm for five years. Within Gowlings, Mr. Clarke is the Montréal office co-leader of Gowlings’ Manufacturing Industry Group and one of the founding members of its Climate Change Practice Group. He is also a member of Gowlings Technology Industry Group with a focus on Cleantech and is involved in student mentoring and supervision of articles.
Mr. Clarke’s practice covers a wide range of business activities with particular focus on the areas of greenhouse gas regulations, carbon markets, secured transactions, mergers and acquisitions, commercial contracts, consumer protection legislation and language legislation. Mr. Clarke has advised institutional clients based inside and outside Québec with regard to secured transactions on moveable property within Québec and in the financing of wind farm projects in the Gaspé Region of Québec. In addition to providing ongoing advice to major clients with regard to consumer protection legislation and language issues, Mr. Clarke has acted as lead counsel in negotiations with the provincially owned power corporation on behalf of multi-national clients as well as in various mergers and acquisitions.
Mr. Clarke has acted in Canada for a major transnational power producer in connection with the transfer of a operational credit producing project under the Clean Development Mechanism of the United Nations Framework Convention on Climate Change as well as in respect of a winding up of the Canadian subsidiary of a major European Aggregator of carbon credits. Mr. Clarke also advises brokers involved in the voluntary carbon credit market and is often called on to speak in relation to the development of regulated Greenhouse Gas Emissions markets in Canada.
