Harry Dahme is a senior partner at Gowlings' Toronto office and leader of the National Environmental Law Practice Group. He has practised exclusively in the area of environmental law since 1984 and has a solid reputation as one of the foremost environmental lawyers in Canada.
Harry is certified by the Law Society as a Specialist in Environmental Law.
Environmental Law
Harry has been involved in all aspects of environmental law. He has experience in advising on environmental risks in corporate transactions and has been actively involved in the development and maintenance of corporate environmental due diligence programs. He provides ongoing advice to business in a wide variety of sectors including manufacturing and service industries on all areas of compliance with federal and provincial environmental legislation. In addition, he has an active advocacy practice which includes defence of prosecutions, appeals to various tribunals including the Environmental Review Tribunal, and civil litigation with respect to environmental claims.
Waste Management
Harry Dahme has been involved in waste management related matters since 1984. He has represented provincial agencies, municipalities, proponents and opponents of waste management facilities. His experience includes negotiating waste supply and waste disposal agreements and obtaining environmental assessment and other required approvals for waste management facilities including landfills, transfer facilities and energy from waste facilities. Harry has also successfully negotiated a variety of community compensation agreements providing benefits to municipalities and residents impacted by waste management facilities.
Alternative Service Delivery of Water and Wastewater Services
Harry has particular expertise in alternative service delivery of municipal environmental services, including water and wastewater. He has represented numerous municipalities in respect of the selection process leading to the identification of the preferred operator for water and wastewater facilities. He has drafted and negotiated management, operations and maintenance agreements between municipalities and operators, and has been involved in the selection of and negotiation with service companies for the Design, Build, Operate and Finance of water and wastewater projects.
Harry continues to provide advice on a regular basis to industry and municipalities on the legal issues relating to the operation and maintenance of water and wastewater facilities.
Policy Advice & Legislative Drafting
Harry has advised business, provincial government agencies and other interested parties on amendments to provincial and federal environmental legislation, including the Ontario Environmental Assessment Act, the Canadian Environmental Protection Act and the Pest Control Products Act.
Energy and Infrastructure
Harry has been active in the area of energy and infrastructure. He has been involved in transmission projects and generation projects such as energy from waste, landfill gas-to-energy, digester gas, hydro power and nuclear projects. His experience ranges from providing ongoing advice on compliance with environmental laws and the establishment and maintenance of the appropriate environmental management systems, to obtaining approvals for new facilities or changes to existing facilities. He continues to be involved in corporate and financing transactions by clients in the energy sector.
In addition to his experience in respect of water and wastewater, Harry’s experience includes experience in transportation and infrastructure projects. That experience includes the full range of environmental legal services including providing advice in respect of the corporate transactions or in the financing of these projects.
Advocacy
Harry has represented clients before every level of Court in Ontario, including the Federal Court and the Federal Court of Appeal. He regularly appears before numerous tribunals, including the Environmental Review Tribunal.
