Kerry Powell is a partner in Gowlings’ Calgary office, practising in the areas of construction, engineering and surety matters with emphasis on contract document preparation, negotiation and interpretation, claim preparation and analysis, plaintiff and defence litigation representation and alternate dispute resolution. He acts on behalf of insurers, owners, general contractors, subcontractors, suppliers, engineering companies, sureties, architects, joint ventures, construction associations, government and various consultants within the construction industry.
Kerry has provided representation on behalf of clients at the Court of Queen's Bench, Court of Appeal and Supreme Court of Canada levels. He has been involved in numerous major projects within Canada and internationally, including the Northumberland Strait/Confederation Bridge, as well as major oil sands, petroleum and natural gas, infrastructure and co-generation projects.
Kerry is a member of the Alberta Arbitration & Mediation Association and has acted as a facilitator, mediator and arbitrator with respect to a variety of construction related disputes involving a number of projects, including the Alliance Pipeline project, and is the architect of both the Alberta Construction Association and the Calgary Construction Association's Alternate Dispute Resolution facilities.
Kerry is also a member of the Canadian Construction Association and has acted as chairman of the Provincial Standards Practice Committee of the Alberta Construction Association, the Premier's Task Force on Alberta Government Contracts, as well as the Provincial Government/Industry Task Force on Builders' Liens. As a past member of the Canadian Construction Association National Documents Committee, he has had input in, and developed an exceptional understanding of, most standard form construction contracts in use in Canada. He is a past director of the Alberta Construction Association and the Calgary Construction Association, as well as an active member of the Surety Association of Canada, the Alberta Construction Owner's Association, the Alberta Roadbuilder's & Heavy Construction Association, and the Consulting Engineers of Alberta. Kerry is also a founding member of the Canadian Bar Association - Construction Section - Alberta.
Kerry is a frequent industry lecturer and has taught construction law at the University of Calgary. He has authored more than 100 articles on topics relating to the building, engineering and bonding industries and is a regular columnist in such publications as Heavy Construction News, Builder/Architect Magazine, Canadian Construction Association - Gold Seal Program Magazine and Alberta Construction Magazine.
