Lynne Watt is a partner in Gowlings' Ottawa office practising in the Advocacy Group. Her areas of expertise are commercial litigation, copyright, (in particular, the certification of tariffs under the Copyright Act and copyright infringement claims) and employment law.
As an advocate, Lynne has appeared before a variety of tribunals and in all levels of court in Ontario, the Federal Court, the Federal Court of Appeal and the Supreme Court of Canada.
She has represented clients in a wide variety of commercial litigation matters, including contract disputes, enforcing proprietary rights and intellectual property, shareholder and executive disputes, oppression remedy proceedings, post-employment matters (non-competition, breach of fiduciary duty, breach of confidence) and procurement claims. Lynne's practice includes employment litigation on behalf of employers, discrimination and disability rights complaints and advising companies on labour and employment issues arising out of corporate mergers and acquisitions and the transfer or sale of businesses. With respect to copyright matters, Lynne appears regularly in proceedings before the Copyright Board of Canada and in judicial review proceedings and appeals of those decisions.
- Represented dissenting unit owners in oppression remedy proceedings against condominium corporation.
- Advised Canadian acquiror on risks associated with purchase of assets subject to litigation in a foreign jurisdiction
- Represented builder in commercial arbitration against neighbouring developer over allocation of development charges and servicing works
- Represented majority shareholders in defence of oppression remedy action commenced by minority shareholder and founder in a small closely-held transportation company
- Successfully obtained Norwich Pharmacal orders on behalf of a financial institution tracing proceeds of fraud
- Represented a Canadian financial institution in an appeal under the Financial Agency of Canada Act
- Represented an Ontario municipality in commercial arbitration proceedings regarding default under multi-year contract to manage landfill site
- Represented a federal Crown Corporation in international commercial arbitration proceedings regarding design and construction of waste management site
- Advised Canadian corporation on disclosure obligations pursuant to a third party disclosure order in matrimontial proceedings
- Represented copyright owners in copyright infringement action against a major sports and entertainment venue
