Marshall Reinhart is a partner in Gowlings' Toronto office. His litigation practice centres on commercial and regulatory matters, with an emphasis on products liability law, class actions and franchising disputes.
In addition, Marshall provides legal advice on issues related to the Charter of Rights and in the area of criminal and quasi-criminal offences. He has extensive experience defending those charged with provincial offences, particularly commercial motor vehicle carriers and drivers facing prosecution for transportation related offences. Marshall has appeared at all levels of court and before administrative tribunals.
Prior to practising law, Marshall worked in the legal publishing industry and as a consultant in the financial services industry in the area of legal and regulatory compliance.
The following is a representative sample of the work in which Marshall is engaged as counsel:
- represented the Government of Ontario before the Walkerton Public Inquiry established to investigate the circumstances surrounding the contamination of the town of Walkerton's water supply.
- acts as counsel for a Canadian tobacco manufacturer in connection with a variety of litigation-related matters.
- successfully represented the former Minister of Finance for Ontario in connection with an RCMP investigation.
- regularly acts for the Tarion Warranty Corporation (formerly the Ontario New Home Warranty Program).
- represents Canada's largest franchised network of business service centres in franchisee disputes.
- defends a number of Canadian and American commercial motor vehicle carriers and their drivers in respect to highway traffic and dangerous goods transportation charges.
Marshall is the editor of the supplemented services Search and Seizure Law in Canada and Choate on Discovery, both published by Carswell. He has also co-authored:
