Patrice Benoit is a partner in Gowlings' Montréal office, specializing in corporate restructuring and insolvency, and commercial litigation.
Patrice represents financial institutions, venture capital corporations, accounting firms, trustees in bankruptcy, trade creditors, as well as companies from various industry sectors. He works primarily in all insolvency-related fields, whether on corporate restructuring and corporate reorganizations under the Bankruptcy and Insolvency Act or the Companies’ Creditors Arrangement Act, on the realization of security or other forms of liquidation of assets. He regularly appears before the Superior Court of Québec (Civil and Commercial Chambers) and the Court of Appeal of Québec.
He is often called upon to speak on banking law and insolvency related matters.
Patrice practises in French and English. Patrice’s corporate restructuring practice is extensive and includes representing key players/stakeholders in numerous files, including the following:
- restructuring under the CCAA of Abitibi Consolidated Inc. (acted for the DIP lender and for the Attorneys General of Ontario, British Columbia and New Brunswick as well as for another major creditor with a disputed claim of about $130,000,000)
- restructuring under the CCAA of Dumoulin Group Inc./Audiotronic Stores (acted for the senior secured creditor)
- restructuring under the CCAA of Kitco Metals Inc., which faces a disputed tax assessment of about $350,000,000 (acting for Kitco)
- bankruptcy of the Norbourg Group of companies, responsible for the most important financial fraud to date in the province of Quebec (acting for the trustee)
- restructuring under the CCAA of Les Ailes de la Mode/San Francisco Stores (acted for the banking syndicate)
- restructuring under the CCAA of the Microtec group of companies (acted for one of the three members of the banking syndicate)
