Sean Murphy is an associate in Gowlings’ Calgary office, practising international anti-bribery law. Sean regularly advises clients on all issues related to Canada’s Corruption of Foreign Public Officials Act (“CFPOA”) and other foreign corruption matters.
Sean has represented clients faced with charges and allegations of foreign bribery on some of the most significant CFPOA cases to date. He is experienced in conducting investigations, providing compliance advice and acting as defence counsel to resolve foreign bribery issues.
Prior to joining Gowlings, Sean worked as an engineer with various resource companies, providing him with insight and exposure to a variety of relevant commercial and operational issues in the resources industry. Anti-Corruption
- Conducting major multijurisdictional bribery investigations around the globe including in Eastern Europe, South Asia, Africa and Latin America
- Defending clients in relation to the Corruption of Foreign Public Officials Act (“CFPOA”) and advising on legal matters involving jurisdiction, liability, disclosure, negotiations and sentencing
- Advising clients on anti-corruption matters on both the buy-side and sell-side in major business transactions including mergers, acquisitions and joint ventures
- Conducting detailed operational risk assessments relating to client operations in over 30 high-risk countries
- Developing anti-corruption compliance programs across a wide spectrum of industries and company sizes operating around the globe, including a company with over 8,000 employees
- Delivering anti-corruption law and compliance training for employees, agents, contractors, executives and board members
- Developing procedures for complex areas of anti-corruption compliance, including: gifts, travel and hospitality of public officials, handling facilitation payments and effective tools for agent due diligence and monitoring
- Advising on agency agreements for business development in foreign locations, as well as service, supply and distribution agreements
