The Bill C-45 amendments to the Criminal Code establish a legal
duty for organizations and their decision makers to ensure that
"reasonable steps" are taken to prevent bodily harm and injury
in the workplace. Failure to comply with this new duty may
result in both individuals and organizations being prosecuted for
OHS criminal negligence, with penalties in the millions of
dollars for organizations. The maximum jail term an individual
could face upon conviction is life imprisonment.
