Carbon emission regulations are imminent in both the United States and Canada. Regulatory regimes to constrain carbon emissions are emerging on state, provincial, regional and national levels across North America. Substantive regulatory announcements are expected from the U.S. and Canadian governments in advance of the United Nations Conference on Climate Change to be held in Copenhagen from December 7 to 18, 2009.

One of the key instruments to drive carbon emission reductions will be the price of carbon established through carbon markets. The trading of carbon instruments linked to greenhouse gas emissions reductions promises the advent of new financial markets in North America. What will these regulatory constraints and the arrival of new carbon markets mean for your business? How should you determine your corporate positioning in light of these developments? What are the opportunities and risks?

We will bring together leading lawyers from the U.S. and Canada to discuss emerging North American carbon markets: regulatory regime design, carbon market opportunities, carbon market transactions and the legal issues they present.

Seminar topics included:

  • Emerging U.S. and Canadian carbon regulations
  • Creating and trading carbon instruments
  • Project carbon finance
  • Pre-compliance carbon markets
  • Due diligence and managing the legal risks in carbon transactions
  • Understanding emission reduction purchase agreements

Panelists:

  • Mark Madras, Gowling Lafleur Henderson LLP
  • Douglas Clarke, Gowling Lafleur Henderson LLP
  • Michael Zimmer, Thompson Hine LLP
  • Andrew Kolesar, Thompson Hine LLP
